Terms of Service

All of our cupcakes and Jarcakes, including the recipes, are designed and made from scratch by us in our fully registered, insured, and exclusively gluten-free kitchen. Our products have been lab tested and confirmed Gluten-Free, at the most sensitive level of <5ppm (less than 5 parts per million). The highest care is taken when producing our products, with quality being our number one priority. Customer satisfaction is very important to us, and we highly value your feedback, as we are always striving for excellence.

Parties

These terms and conditions form a legally binding agreement between The Daily Cupcake Co. Pty Ltd (ACN 648 178 376) trading as The Daily Cupcake Co. (The Daily Cupcake Co; Us; We; Our) and the person specified in any order for Our services (Customer; Client; You).

GST (Goods & Services Tax)
All prices quoted on this website include GST for orders placed within Australia, unless explicitly stated.

Purchase and Delivery

  • Prices are subject to change at any time without notice.

  • Any discount codes must be used at time of checkout, and cannot be applied retroactively.

  • We accept no responsibility for cupcakes or jarcakes once they have left our possession. No refunds will be given due to mishandling or incorrect storage.

  • You will be sent an email upon purchase containing your order number and order details, and an email confirming delivery once complete.

  • It is the responsibility of the customer to read the ingredients listed. We will not be held liable for any allergic reaction resulting from consumption of our cupcakes.

    Local Delivery - Tamworth 2340

  • If no-one is at the delivery address to accept the product, the product will be left in a safe, weather protected space at the address specified, as we see fit. Where necessary, we will cover with cardboard to shelter from direct sunlight.

  • Local delivery charges are determined according to suburb, and delivery costs will be added to your order before processing, if relevant.

  • If the incorrect delivery details are provided or we are unable to gain access to the property, we may need to contact you to arrange re-delivery which may incur a re-delivery fee. No refunds will be given based on incorrect details, or lack of access.

  • Delivery is available Monday-Friday, with the exception of custom orders which can be delivered 7 days a week, at our discretion. Weekend delivery may incur a surcharge.

    Australia Wide Delivery

  • All orders are dispatched within 1-2 business days of receipt, or if Jarcakes are pre-ordered, on the Monday of the selected week.

  • Orders are posted Monday-Thursday in an effort to minimise perishable items spending extended periods of time in postal warehouses over the weekend. Orders received from Thursday-Sunday will be sent from Monday onwards.

  • All orders are sent with tracking. Tracking details will be emailed to the customer upon dispatch.

  • We use Australia Post as our third party delivery partner. Deliveries are made within business hours.

  • We recommend orders which include Jarcakes be shipped using Express Post. The vast majority of orders posted via Express are received within 1-3 business days, however rural areas may be delayed by an additional day. Time-frames for arrival can be found on the Australia Post website here. Enter 2340 as the ‘Shipping from’ destination. We not be responsible for items received in poor condition if the customer does not select Express Shipping for perishable items.

  • Orders can be shipped to any address within Australia that are within the Australia Post network. Authority to leave is assumed on all orders, and if no one is present to accept the delivery, Australia Post will leave it in a safe place, at their discretion.

  • We cannot be held responsible if the incorrect shipping details are provided. Should the item be undeliverable, or returned to sender, we will not be responsible for reimbursement of shipping costs, or give a product refund based on incorrect information entered by the customer.

  • In the event that your order arrives damaged or is incorrect, please contact us with a photo of your order and brief description and we will discuss next steps. If the issue is a fault of ours, we will offer a replacement or refund of your order. If the issue is the fault of our shipping partner, (i.e. damaged in transit), please contact Australia Post and use your tracking number provided via email when your parcel was shipped. Should we investigate this issue on your behalf, liability is limited to the amount of any compensation we are able to recover from the third-party postal service, less our reasonable costs of investigating and applying for any compensation, unless otherwise required by law.

Custom Orders

  • Custom orders must be confirmed and payment received at least 48 hours prior to delivery, otherwise they will be assumed cancelled.

  • No refunds will be issued if cancellation is within 48 hours of delivery date.

  • Changes requested within 48 hours of delivery will be made at our discretion, and are not guaranteed.

Refund Policy

  • Refunds on Cupcakes & Jarcakes will not be given except in exceptional circumstances, at our discretion. Cupcakes and Jarcakes are made to order, and are a perishable food product, so cannot be re-sold in accordance with Consumer Law.

  • Refunds or Exchanges on retail stock will not be considered in the event of change of mind, so please choose carefully.

  • Due to hygiene reasons, refunds and exchanges will not be given on food products or products with come into direct contact with food, according to Consumer Law. This includes, but is not limited to, Sprinkles, Food Colouring, Piping Tips & Bags, and Ingredients.

  • Should you receive damaged, faulty, or incorrect stock, please contact us at hello@thedailycupcakeco.com within 5 days of receiving your order for next steps.

  • Returns are managed on a case-by-case basis. Please contact us BEFORE initiating a return, within 5 days of receiving your order at hello@thedailycupcakeco.com. If approved, items need to posted, with tracking, within 5 days, in unused, unopened condition. Shipping and return shipping costs are the responsibility of the customer, and will not be refunded.

  • Refunds will be issued within 2 business days of confirmation, back to the original payment method.

  • Store credit issued is valid only for the product, and does not include delivery charges.

  • For retail stock orders, cancellation will only be considered prior to dispatch, and will incur a 10% restocking and administration fee. This will be deducted from your refunded amount, along with any payment processing fees. Once the order has been dispatched, we cannot cancel it, and it will be considered a change of mind purchase.

  • We will always work with you to rectify any problems, so be sure to reach out if you are not satisfied with any aspect of our service.
